(Draft) Since its establishment in 1959, the European Court of Human Rights aims to guarantee the realization of human rights principles in Europe. The ECHR framework obliges national courts to interpret the decisions and apply them in their own manners. It is well-known that domestic judges accept certain citizens’ demands for inclusion while rejecting others. How do the European Courts’ rulings effectively change the notion of refugee rights across Europe? Can one trace the European norm diffusion in France over-time to analyze the intensity of ECHR reception in domestic courts?
